CONCERNING
CUSTOMS PROCEDURES ON THE ENTRY AND RELEASE OF YACHTS IN THE FRAMEWORK OF SAIL BANDA 2010

To:

In relation with Presidential Decree No. 35 of 2009 concerning the National Committee for Implementation of Sail Banda in 2010, it is necessary to publish a technical guide on customs procedures for the entry and release of yacht in the framework of Sail Banda 2010 as follows:

A. General

Entry and release procedures of yacht in the framework of Sail Banda 2010 to and from customs area set out in this Circular is used to giver service facility and supervision on the yachts that follows the activities of Sail Banda 2010.

B. Implementation Technical Team

In the framework to implement facilitation on the service and control yachts that take part in Sail Banda 2010, Director General establishes Technical Team on the Implementation of Sail Banda 2010 that is led by Director of Customs Technical based on Decree of the Director General.

C. Port of Entry and Release

1. Sea ports are stipulated as ports of entry and also as ports of release are:

2. In case of entry and release is in other ports than as intended in paragraph (1), yacht rally participants must report to the nearest Customs Office or Integrated Post of Sail Banda 2010 in destination port.

D. TEMPORARY IMPORT OF YACHTS

1. Category of Temporary Import of Yachts.

On the entry of yacht in the framework of Sail Banda 2010 is get temporary import permit by get exemption of import duty.

2. Application to obtain Temporary Import Permit

To obtain a temporary import permit, the Director General of Supervision and Control of Marine and Fisheries Resources (P2SDKP) Ministry of Marine and Fisheries as Chairman of the Organizing Committee of Sail Banda 2010 apply for a temporary import permit to the Director General of Customs and Excise.

4. Period

Period of temporary import permit of yachts in the framework of Sail Banda 2010 to the Indonesia customs area is given for a period up to December 31, 2010.

E. CUSTOMS OBLIGATION

1. Customs Documents

To simplify and smooth of service, the Customs Office or Technical Team on the Implementation of Sail Banda 2010 prepare the necessary customs documents.

F. BASIC VALUE TO CALCULATE IMPORT DUTY (NDPBM)

Basic Value to Calculate Import Duty (NDPBM) contained in the PIB and PEB documents in the framework of Sail Banda 2010 is set at Rp. 9,500.00 per 1 U.S. Dollar

G. NONTAX STATE LEVY (PNBP)

PNBP payment on the every customs service in the framework of Sail Banda 2010 is charged to the budget of Directorate General of P2SDKP.

H. SANCTIONS

1. Temporary Import permit of yacht based on this Circular is only used in the framework of Sail Banda 2010 and should be released from Indonesian customs area before ending period of temporary import permit.

2. In case of yacht is not released from customs area after ending period of temporary import permit and/or used for other purpose than activities of Sail Banda 2010, will be penalized according to the provisions in force.

This is to be implemented with the full sense of responsibility.
